    I am a member of a 6 unit owner condo corp whose bylaws require 4 board members. At an annual general meeting we were only successful getting 3 members to become board members. Does that mean we are unable to move forward with business such as passing a budget assessing condo fees, etc? Further to this, the bylaws state that each board member must be appointed by a unit holder. In this case, can a condo corp member appoint more than one person and do the condo regulations or act preclude two members of a condo being appointed to the board.

    We are also interested in this question because we are a 4 unit condominium corporation and are not able to sustain the required number of board members.

    Your Bylaws should reference what powers to appoint exist. If not, you would have to refer back to the Condominium Act.

    I agree with Brian. However, you are essentially asking us for legal advice that we are not qualified to give.

    As Brian says, review your bylaws for any guidance and have a look at the Condominium Property Act, available online from the Alberta Queens Printer.

    If these options fail, I recommend contacting a lawyer specializing in condo law. There are 3 legal firms who sponsor COF, but there are other qualified condo specialist lawyers to consider also.
