    Does an owner has a legal right to see engineers original report regarding his windows?

    An owner noticed that the report which was provided as a justification for the board’s request to replace windows wasn’t the original one. Several requests to see the original one remain unresponded.Does an owner has a legal right to see the original report regarding engineers report about his windows?

    COF is an advocate for transparency. The Government of Alberta , through Service Alberta has issued “Condominium documents : for owners, mortgagees and prospective purchasers”

    In our experience, all engineering reports should be readily available to owners. However, draft engineering reports are not normally provided as they have not been approved by technical staff or the condo Board of Directors.

      Thank you Terry.

      Unknown to the board, the original report was shown to me. It contained very important information regarding the exterior problems with the window and reasons for the leaky roof. All that was omitted from the supplentary report and a suggestion to replace the window was added.

      It’s important to note that the original report clearly stated that just replacing the window will not fix the problem. That was also taken out.

      I guess that explains why the board is not releasing the original report to me.

      In addition to spending money on the engineers they retained a lawyer to serve me with a notice to replace a $8.000 panoramic window instead of just having it caulked as per a report from their own contractor received three years ago. A report which was also witheld from me and stated that caulking needs to be done ASAP.

      Unfortunately, it’s board’s like these that turn people off to condo living.

    I would be very cautious relying on a report that had not been finalized by professionals or approved by the board.

    Board’s need to control the exterior presentation of a condo. How the exterior of the building looks and how it protects the envelope are both very important.

    Unfortunately, owners who make changes to the exterior without board approval may suffer the consequences.

    The situation you have found yourself in is most unfortunate for all.

    We all need to recognize that It is not easy to be a volunteer on a Board of Directors either.
