We had a similar event in our bareland condo.  Although we weren’t aware of the change to the legislation, we put it through our condo insurance.  They took care of getting the repairs done.  In this case, too, the cost was less than the deductible.  It was charged back to the owner whose insurance should have paid it since it was less than the deductible.  I’m not sure what would happen if the cost would have exceeded the deductible.  I would expect that the owner would be charged a special assessment for the excess.  I am very interested to know if other condo’s see it the same way.
